The Innovations for Ocean Action Foundation (I4OA), in application of the legislation in force on the protection of personal data, informs you that the personal data collected through the forms on the website ocean-action.org are included in specific automated files for users of the services of the Innovations for Ocean Action Foundation (I4OA).
The collection and automated processing of personal data are carried out for the purpose of maintaining our relationship with you and carrying out information, training, advisory and other activities that are part of the work of the Innovations for Ocean Action Foundation (I4OA).
These data will only be disclosed to those entities where this is necessary for the sole purpose of fulfilling the purposes described above.
The Innovations for Ocean Action Foundation (I4OA) adopts the measures necessary to guarantee the security, integrity and confidentiality of the data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

You declare that all the data you provide are true and correct, and you undertake to keep them up to date by communicating any changes to info@ocean-action.org.
Purpose of Processing Personal Data:
For what purposes will we process your personal data?
At the Innovations for Ocean Action Foundation (I4OA), we will process the personal data we collect through the website ocean-action.org for the following purposes:
- If you contract any of the services offered through ocean-action.org, to maintain the contractual relationship and to manage, administer, inform, deliver and improve the service.
- To send information requested through the forms provided on ocean-action.org.
- To send bulletins (e.g. newsletters) and informational, news and/or promotional communications about the Innovations for Ocean Action Foundation (I4OA) and the sector.
You may object to receiving communications by any channel, at any time, by sending an email to the address indicated above.
The fields in these forms are mandatory. It will be impossible to fulfil the stated purposes if you do not provide the requested data.
For how long will the personal data collected be kept?
The personal data provided will be kept for as long as the relationship with the Foundation is maintained, or until you request their deletion, always in accordance with the applicable data protection regulations.
Legal Basis:
Your data are processed on the following legal bases:
- Your request for information and/or the contracting of services from the Innovations for Ocean Action Foundation (I4OA), the terms and conditions of which will be made available to you, in any case, prior to a potential contract.
- Your free, specific, informed and unambiguous consent, given that you are informed and provided with this Privacy Policy, which you may accept—if you agree—by way of a statement or a clear affirmative action, such as ticking a box provided for that purpose.
If you do not provide us with your data, or you provide them incorrectly or incompletely, we will not be able to deal with your request, and it will be impossible for us to provide you with the requested information or to conclude any service contract.
Data Uploaded by Users of the Services:
In cases where a user includes files with personal data on shared hosting servers, the Innovations for Ocean Action Foundation (I4OA) is not responsible for any failure by the user to comply with the GDPR.
Data Retention under the LSSI:
La Fundación Innovations for Ocean Action (I4OA) informa de que, como prestador de servicio de alojamiento de datos y en virtud de lo establecido en la Ley 34/2002 de 11 de julio de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI), retiene por un periodo máximo de 12 meses la información imprescindible para identificar el origen de los datos alojados y el momento en que se inició la prestación del servicio. La retención de estos datos no afecta al secreto de las comunicaciones y sólo podrán ser utilizados en el marco de una investigación criminal o para la salvaguardia de la seguridad pública, poniéndose a disposición de los jueces y/o tribunales o del Ministerio que así los requiera.
The communication of data to law enforcement authorities will be carried out in accordance with the legislation on personal data protection.
Intellectual Property Rights:
The Innovations for Ocean Action Foundation (I4OA) is the holder of all copyright and intellectual and industrial property rights, know-how and any other rights related to the contents of the website ocean-action.org and the services offered therein, as well as to the software required for its implementation and the related information.
The reproduction, publication and/or use—in whole or in part—of the contents of the website ocean-action.org for purposes other than strictly private use is not permitted without the prior written consent of I4OA.
Intellectual Property of Software:
The user must respect the software of third parties made available by the Innovations for Ocean Action Foundation (I4OA), even where such software is free and/or publicly available. The Innovations for Ocean Action Foundation (I4OA) holds the exploitation and intellectual property rights necessary with respect to such software.
The user does not acquire any rights or licence, by virtue of the contracted service, over the software required for the provision of the service, nor over the technical information used to monitor the service, except for those rights and licences necessary to use the services contracted and only for the duration of such services.
For any activity that goes beyond strict compliance with the contract, the user must obtain prior written authorisation from the Innovations for Ocean Action Foundation (I4OA). The user is prohibited from accessing, modifying or viewing the configuration, structure and files of the servers owned by the Innovations for Ocean Action Foundation (I4OA), and will be liable, both civilly and criminally, for any incident that may arise in the servers and security systems as a direct consequence of negligent or malicious action on their part.
Intellectual Property of Hosted Content:
The following uses of the services provided by the Innovations for Ocean Action Foundation (I4OA) are prohibited where they contravene intellectual property legislation, in particular:
- Any use that is contrary to Spanish law or that infringes the rights of third parties.
- The publication or transmission of any content that, in the opinion of the Innovations for Ocean Action Foundation (I4OA), is violent, obscene, abusive, illegal, racist, xenophobic or defamatory.
- The distribution of “cracks”, serial numbers for programmes or any other content that infringes third-party intellectual property rights.
- The collection and/or use of personal data of other users without their express consent or in breach of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).
- The use of the domain’s mail server and email addresses to send unsolicited bulk email.
The user is fully responsible for the content of their website, for the information transmitted and stored, for hyperlinks, for third party claims and for any legal actions relating to intellectual property.
Third Party Rights and Protection of Minors:
The user is responsible for complying with the laws and regulations in force and with the rules governing the operation of online services, electronic commerce, copyright, maintenance of public order and the generally accepted principles of Internet use.
The user will indemnify the Innovations for Ocean Action Foundation (I4OA) for any expenses arising from the involvement of I4OA in any matter for which the user is responsible, including legal fees and defence costs, even in the event of a non-final court decision.
Protection of Hosted Information:
The Innovations for Ocean Action Foundation (I4OA) makes backups of the content hosted on its servers; however, it is not responsible for the loss or accidental deletion of data by users. Likewise, I4OA does not guarantee the full restoration of data deleted by users, as such data may have been removed and/or modified since the last backup.
The services offered, except for specific backup services, do not include the restoration of content stored in the backups made by the Innovations for Ocean Action Foundation (I4OA), where the loss of content is attributable to the user. In such cases, a fee will be set in accordance with the complexity and volume of the recovery, subject always to the user’s prior acceptance.
The restoration of deleted data is only included in the service price when the loss of content is due to causes attributable to the Innovations for Ocean Action Foundation (I4OA).
Commercial Communications:
In application of the LSSI, the Innovations for Ocean Action Foundation (I4OA) will not send advertising or promotional communications by email or other equivalent electronic means that have not been previously requested or expressly authorised by the recipients.
In the case of users with whom there is a prior contractual relationship, the Innovations for Ocean Action Foundation (I4OA) is authorised to send commercial communications relating to products or services of I4OA that are similar to those that were initially contracted.
In any case, and once the user’s identity has been verified, the user may request that no further commercial information be sent by using the channels enabled for that purpose.
Language
This Privacy Policy (including the provisions on content, hosting and information) has been drafted in Spanish. Any version in another language is provided for information and convenience only. In the event of any discrepancy between the Spanish version and any translation, the Spanish version shall prevail.
